1. BINDING AGREEMENT AND JURISDICTIONAL SCOPE
Engaging in any transaction, negotiation, or digital interaction with Whitefield Yamaha constitutes unconditional acceptance of these formal Terms and Conditions.
- Contractual Supremacy: This document serves as the definitive legal contract governing the sale of motor vehicles, the procurement of genuine spare parts, and the provision of mechanical services. It supersedes all prior verbal or written communications.
- Authorized Operations: All operations, deliveries, and agreements are exclusively managed through our two authorized retail facilities located at Whitefield Main Road and ITPL Main Road in Bengaluru.
2. VEHICLE BOOKING, ALLOCATION, AND PRICING DYNAMICS
The reservation of any specific Yamaha motor vehicle requires strict adherence to dealership allocation protocols.
- Mandatory Advance: A booking is legally recognized only upon the immediate realization of a stipulated booking advance in the dealership bank account.
- Inventory Allocation: The dealership provides zero guarantees regarding immediate inventory allocation upon payment. Vehicle distribution depends entirely on supply chain logistics controlled by Yamaha Motor India.
- Dynamic Pricing: The final invoice value charged to the customer will be exclusively determined by the ex-showroom prices, statutory taxes, insurance premiums, and RTO levies prevailing on the exact date of vehicle delivery. The customer must bear any pricing changes implemented by the manufacturer between the booking date and the delivery date.
3. CANCELLATION PROTOCOLS AND FINANCIAL REFUNDS
Customers retain the right to cancel vehicle bookings prior to the initiation of the RTO registration process.
- Administrative Deductions: All cancellations are subject to standardized administrative deduction charges intended to cover processing and operational overhead.
- Refund Channels: The dealership will process the remaining refund amount exclusively through the original digital payment channel utilized by the customer. Cash refunds are strictly prohibited.
- Processing Timelines: The standard processing window for financial refunds ranges from ten to fifteen business days following the submission of a formal, written cancellation request.
4. VEHICLE FINANCING AND CREDIT PROTOCOLS
Whitefield Yamaha enforces stringent policies regarding third-party vehicle financing and credit disbursements.
- Payment Clearance Mandate: The dealership requires the absolute realization of all invoiced funds, including margin money and loan disbursements, before any vehicle is dispatched for permanent RTO registration.
- Delivery Order (DO) Contingency: For transactions involving vehicle financing, the delivery and registration processes remain entirely contingent upon the dealership receiving the formal Delivery Order (DO) and the subsequent disbursement of funds from the respective financial institution.
- Margin Money/Down Payment: The customer must clear the complete margin money (down payment) via authorized banking channels prior to invoicing.
- Loan Rejections and Delays: The dealership accepts absolutely no liability for delivery delays, pricing changes, or transaction failures resulting from loan rejections, documentation errors, or processing delays originating from the customer's chosen bank or non-banking financial company (NBFC).
- Hypothecation: Financed vehicles will carry a mandatory hypothecation endorsement in favor of the lending institution on the RTO Registration Certificate.
5. DELIVERY PROTOCOLS AND TRANSFER OF LIABILITY
Vehicle handover processes are structured to ensure absolute transparency and immediate transfer of liability.
- Logistical Approximations: Estimated delivery timelines communicated by dealership personnel represent logistical approximations based on current inventory and manufacturer dispatch schedules. These timelines hold no binding legal weight.
- PDI Mandate: Upon the final handover of the vehicle, the customer is legally mandated to execute a comprehensive Pre-Delivery Inspection (PDI).
- Liability Transfer: By signing the official delivery receipt and physically removing the vehicle from the dealership premises, the customer legally acknowledges that the vehicle is free from cosmetic defects, missing parts, or immediate mechanical faults. Whitefield Yamaha is completely absolved of all liability regarding physical damage discovered after the vehicle exits the showroom boundaries.
6. SERVICE OPERATIONS, ESTIMATES, AND WARRANTY INTEGRITY
Mechanical services and warranty claims operate strictly under manufacturer guidelines.
- Tentative Estimates: All monetary estimates provided by service advisors prior to the initiation of mechanical repairs are strictly tentative approximations. The final service invoice will accurately reflect the exact cost of labor utilized and the specific genuine Yamaha spare parts consumed during the repair cycle.
- Warranty Underwriter: The vehicle warranty is underwritten and provided exclusively by Yamaha Motor India, not the dealership.
- Warranty Nullification: Maintaining the validity of this manufacturer warranty requires the customer to adhere strictly to the prescribed service intervals at authorized Yamaha service centers. The installation of aftermarket electrical accessories, unauthorized mechanical modifications, or the utilization of non-genuine spare parts will result in the immediate and irreversible nullification of the manufacturer's warranty.
7. REGULATORY COMPLIANCE AND RTO REGISTRATION
Whitefield Yamaha acts strictly as a facilitating agent between the customer and the Regional Transport Office (RTO).
- Customer Responsibility: The customer bears sole responsibility for providing accurate, legally valid, and physically legible documentation required for the registration process.
- Exemption from Liability: The dealership holds no liability for delivery delays or legal complications arising from RTO server downtimes, unverified customer documents, or changes in regional transportation laws.
- Temporary Registrations: Temporary registrations, if requested and legally permissible, carry a strict validity period of thirty days. The customer assumes all legal responsibility for operating an unregistered motor vehicle upon expiration.
8. TEST RIDE INDEMNIFICATION
The provision of demonstration vehicles for test rides remains subject to availability and dealership discretion.
- Licensing Requirements: Customers requesting a test ride must present a valid, unexpired Permanent Driving License authorizing the operation of geared two-wheelers.
- Assumption of Risk: By operating the demonstration vehicle, the rider assumes full legal and financial responsibility for any traffic violations, third-party property damage, or physical damage inflicted upon the vehicle due to negligence, improper operation, or failure to adhere to Indian traffic regulations during the test ride period.
9. LIMITATION OF LIABILITY AND DISPUTE RESOLUTION
Legal and financial liabilities are strictly capped.
- Liability Cap: To the maximum extent permitted by Indian law, Whitefield Yamaha, its directors, and its employees shall not be held liable for any indirect, consequential, punitive, or incidental damages arising from the use of sold vehicles, provided services, or digital platform interactions.
- Arbitration: In the event of a contractual dispute or consumer grievance, the matter shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.
- Jurisdiction: The exclusive legal jurisdiction for all disputes, legal filings, and arbitration proceedings shall remain the courts located in Bengaluru, Karnataka.
